Terms of Service

These Terms of Service govern your use of the Bario platform. Please read them carefully before using the Service.
1. Acceptance of Terms
By creating an account or using the Bario platform ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are accepting on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.
You must be at least 18 years old to use the Service. If you do not agree to these Terms, do not use the Service.
2. Description of Service
Bario provides a cloud-based point-of-sale and order management system for restaurants, cafés, and beach bars. The Service includes order management, floor plan design, kitchen and bar displays, printer support, role-based access, and reporting.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes where possible.
3. Accounts & Registration
Each subscription covers one company account. You are responsible for all activity that occurs under your account, including the actions of employees and other users you invite.
You must provide accurate and complete information during registration and keep it up to date. You are responsible for maintaining the confidentiality of your credentials. Notify us immediately at hello@bario.gr if you suspect unauthorised access.
We reserve the right to refuse registration or cancel accounts at our discretion.
4. Subscription & Billing
The Service is offered on a subscription basis. Subscriptions are billed in advance on a monthly or yearly cycle, in Euro (€), through Stripe.
- Auto-renewal: subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
- Yearly plans: billed upfront for the full year. No partial refunds are issued for the unused portion of a yearly plan.
- Monthly plans: no refunds for partial months after a billing cycle has started.
- Price changes: we will provide at least 30 days' notice by email before any price increase takes effect.
- Failed payments: if a payment fails, we will attempt to retry. After repeated failures, the account may be suspended until payment is resolved.
5. Promo Codes & Coupons
We may from time to time offer promotional discount codes or coupons. Unless otherwise stated:
- Codes are issued at our sole discretion and may be withdrawn at any time.
- Codes cannot be combined with other offers unless explicitly stated.
- Codes have no cash value and cannot be redeemed for cash.
- Codes may have expiry dates, usage limits, or plan restrictions.
- Codes are non-transferable and for the intended recipient only.
6. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Scrape, crawl, or use automated means to access the Service beyond normal usage.
- Use the Service to process or store illegal content.
- Impersonate any person or entity.
- Attempt to gain unauthorised access to other accounts or our systems.
- Use the Service in any way that violates applicable law or regulation.
Violation of these rules may result in immediate account suspension without refund.
7. Your Data
You retain full ownership of all data you input into the Service, including orders, menus, employee records, and customer information. We process this data solely to provide the Service to you.
On cancellation, you have 30 days to export your data via the platform. After this period, your data will be permanently deleted from our systems. Payment records are retained separately as required by law (see our Privacy Policy).
8. Intellectual Property
The Bario software, design, trademarks, and brand are owned by Bario and are protected by applicable intellectual property law. Nothing in these Terms grants you any rights to use our brand, trademarks, or proprietary materials.
Your data and content remain your property at all times.
9. Service Availability
We target 99.5% uptime, excluding scheduled maintenance. We will endeavour to schedule maintenance outside peak hours and provide advance notice where possible. We are not liable for downtime caused by factors outside our control, including third-party service outages, internet disruptions, or force majeure events.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Bario shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, loss of goodwill, or business interruption, arising from your use of or inability to use the Service.
Our total cumulative liability to you for any claims arising under these Terms shall not exceed the total amount paid by you to Bario in the three (3) months immediately preceding the event giving rise to the claim.
11. Termination
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
We may suspend or terminate your account with notice for violation of these Terms. For severe violations (e.g. illegal activity, security threats), we may terminate immediately without prior notice.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Greece. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Greece.
13. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice by email before the new Terms take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
